Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the Smart VC application, including the mobile applications for Android and iOS and the District Administration Dashboard (collectively, the “Platform”). Smart VC is a role-based digital governance platform developed by LushAI Tech.

By accessing or using Smart VC, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not use the Platform. Accounts are created and assigned by authorised District Admins or Council Presidents — continued use following account activation constitutes acceptance of these Terms.

In these Terms, the following definitions apply:

• “Smart VC” or “Platform” refers to the Smart VC application, including the Android and iOS mobile apps and the District Administration Dashboard.
• “User” refers to any individual provisioned with an account on the Platform, including District Admins, Council Presidents, VC Secretaries, Treasurers, and VC Members.
• “District Admin” refers to authorised officers of the District Administration who hold supervisory and account-management privileges.
• “Village Council” or “VC” refers to the local governance body under whose jurisdiction Records and correspondence are maintained.
• “Records” refers to all administrative data created within the Platform, including meeting minutes, resolutions, village works records, financial register entries, correspondence, and associated attachments.
• “Audit Trail” refers to the immutable log of all significant actions performed within the Platform, including user identity, timestamp, and action details.

Smart VC does not support self-registration. Access is granted exclusively through accounts provisioned by authorised District Admins or Council Presidents. Each user is assigned a single active role at any given time, and accounts are authenticated via one-time password (OTP) sent to the user's registered mobile number.

Users are responsible for ensuring that only they use their registered mobile number for authentication. Sharing OTP codes or allowing another person to access the Platform using your credentials is strictly prohibited.

The Platform reserves the right to deactivate accounts at any time at the discretion of the District Admin or Council President, including upon departure from office, role reassignment, or suspected misuse.

As a User of Smart VC, you agree to:

• Use the Platform only for official Village Council and District Administration purposes.
• Ensure that all Records, correspondence, financial entries, and other data you create or submit are accurate, complete, and truthful.
• Maintain the security of your registered mobile number and report any suspected unauthorised access to your District Admin or Council President immediately.
• Comply with all applicable laws, regulations, and government directives in your use of the Platform.
• Cooperate with any audit, investigation, or compliance review conducted by authorised personnel.

You must not use Smart VC to:

• Attempt to gain unauthorised access to any part of the Platform, other user accounts, or data belonging to other Village Councils.
• Share, transfer, or disclose your authentication credentials (mobile number OTP) to any other person.
• Upload files in formats other than those supported (PDF, JPG, PNG) or files that exceed the specified size limits.
• Bypass, circumvent, or interfere with any audit trail, review process, approval workflow, or access control mechanism.
• Create, modify, or delete Records in a manner that is fraudulent, misleading, or intended to compromise data integrity.
• Use the Platform for personal, commercial, or political purposes unrelated to official Village Council or District Administration functions.
• Interfere with the operation, availability, or security of the Platform, including through denial-of-service attacks, malware, or exploitation of vulnerabilities.

Violation of these acceptable use terms may result in immediate account deactivation and referral to appropriate authorities.

All Records created, modified, or transmitted through Smart VC are official government administrative documents. The following integrity safeguards apply:

• All Record updates are versioned, not destructive overwrites — previous versions are preserved for audit purposes.
• Financial register (cashbook) entries follow an append-only model. Corrections are made through reversal entries, not edits to original entries.
• Correspondence, once sent, is immutable and cannot be recalled, edited, or deleted.
• The Audit Trail is append-only and non-mutable. Every significant action is permanently recorded with actor identity, role context, and timestamp.
• Records are archived, not deleted. Permanent deletion is restricted to exceptional circumstances (e.g., mistaken uploads) and requires authorisation with a mandatory reason.

Users acknowledge that their actions within the Platform are permanently traceable and attributable. By using Smart VC, you consent to the creation and retention of Audit Trail records associated with your account.

Smart VC is designed to ensure administrative continuity across changes in personnel:

• When a User leaves office, their account is deactivated — not deleted. Deactivated accounts cannot log in.
• All official Records created by the departing User — including meeting minutes, resolutions, works records, and correspondence — remain accessible to their successor and other authorised Users within the Village Council.
• Private one-to-one messages are an exception: these are not accessible to a successor, protecting the confidentiality of personal communications.
• Audit Trail entries associated with a departing User remain permanently in the system and cannot be removed.

The Smart VC platform — including its design, source code, user interface, trademarks, and documentation — is the intellectual property of LushAI Tech. Users are granted a limited, non-exclusive, non-transferable licence to use the Platform solely for authorised official purposes.

Administrative Records created within the Platform remain the property of the respective Village Councils, as applicable. Users do not acquire personal ownership of Records created in the course of their official duties.

You may not reproduce, distribute, reverse-engineer, decompile, or create derivative works of any part of the Smart VC platform without prior written consent.

We strive to maintain continuous availability of the Smart VC platform. However, the Platform is provided on an “as-is” and “as-available” basis. We do not guarantee uninterrupted, error-free, or secure operation at all times.

The Platform may be temporarily unavailable due to:

• Scheduled maintenance and system updates.
• Network, infrastructure, or third-party service provider outages.
• Emergency security measures to protect data integrity.

We reserve the right to modify, update, or discontinue features of the Platform at any time, with reasonable notice where practicable. Changes to Platform features do not constitute a breach of these Terms.

To the maximum extent permitted by applicable law:

• LushAI Tech shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the Platform.
• We are not liable for any loss of data arising from User error, device failure, or circumstances outside our reasonable control.
• Our total liability for any claim arising under these Terms shall not exceed the direct damages actually incurred, subject to applicable government liability frameworks.

Nothing in these Terms shall exclude or limit liability for fraud, wilful misconduct, or any liability that cannot be excluded under applicable law.

Your use of Smart VC is also governed by our Privacy Policy, which describes how we collect, use, store, share, and protect your personal and administrative data. The Privacy Policy is incorporated into these Terms by reference. By accepting these Terms, you also acknowledge the data practices described in the Privacy Policy.

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising from or in connection with these Terms or your use of the Platform shall be subject to the exclusive jurisdiction of the courts in Mizoram, India.

If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.

These Terms may be updated periodically to reflect changes in the Smart VC application, applicable law, or operational practices. When material changes are made:

• The updated Terms will be published within the Smart VC application and on the official department portal.
• The effective date at the top of this document will be updated.
• Users will be notified via an in-app notification at their next login.

Continued use of Smart VC after the effective date of any revised Terms constitutes acceptance of the updated Terms.
